I love how they make a concession that they'll indemnify them... when all these people would have an action against the company were they to suffer any damage as a result of their negligence anyway...

Not sure because I don't know much about the Data Protection Act. However, if there is nothing about damages/compensation in the Data Protection Act they would probably have to sue in Tort and in order to do so they would have to prove damage.

Which could be as simple as showing they were very stressed, upset and put in fear by the whole thing and had to change all bank accounts etc...

How successful they'd be is something else entirely.

To be fair voluntary indemnification is a far sight better than having to drag a tort claim through the courts.

I don't think so, I think it is merely what one should expect. For instance, I don't think it is laudable when a bus gets me somewhere on time. Lauded mediocrity is a dangerous thing. It would be laudable if the company gave these people some compensation, it is the lowest expected for them to indemnify them and it would be despicable if people had to resort to the courts to assert their rights.

Well, are they lauding or are they reassuring? It would indeed be troublesome and undesirable if people had to resort to the courts to assert their rights ("despicable" might be a bit strong a word, considering that it happens all the time) and if the public thought that people would have to resort to the courts to assert their rights against this company for its negligence then damage to its reputation would be even greater, and indeed it would be disproportionate to the reality of the situation. I'm not sure they can be accused of lauding for trying to prevent disproportionate damage to their reputation.
